This Legal Process & Law Enforcement Requests Policy (the "Policy") describes how Scalar Dynamic evaluates, responds to, and complies with legal process, governmental requests, regulatory obligations, and analogous legal notices relating to the Services.
This Policy applies to all requests for information, data, access, action, restriction, disclosure, suspension, or enforcement measures received by Scalar Dynamic in connection with Customer accounts, content, systems, or Services.
This Policy is intended to ensure that Scalar Dynamic responds to legal and regulatory obligations in a lawful, proportionate, and consistent manner while balancing compliance requirements, customer rights, and operational integrity.
Scalar Dynamic is subject to and operates in compliance with applicable laws, regulations, and legal obligations of the jurisdictions in which it is established, operates, or provides Services, including, among others, the laws of the European Union and the Republic of Estonia.
Scalar Dynamic may also be required to comply with applicable laws, regulations, or legal obligations arising from the jurisdiction in which a Customer operates, is established, or directs the use of the Services, to the extent such laws are validly applicable.
This Policy governs Scalar Dynamic’s handling of legal process, governmental requests, regulatory actions, and other legally binding obligations, and is applied in conjunction with Scalar Dynamic’s contractual obligations, privacy policies, and applicable data protection laws.
Scalar Dynamic shall respond only to requests that are lawful, reasonable, and legally binding under applicable law, including subpoenas, court orders, warrants, regulatory directives, or other valid legal process issued by a competent authority.
All requests are subject to verification of legal validity, jurisdiction, authority, scope, and form. Scalar Dynamic may require clarification, supplemental documentation, or confirmation of authority before taking action.
Requests that are informal, incomplete, overly broad, vague, improperly issued, or not legally enforceable shall not obligate Scalar Dynamic to act.
Nothing in this Policy shall be construed as an agreement to voluntarily comply with requests that do not meet applicable legal standards.
All legal process, governmental requests, and regulatory notices received by Scalar Dynamic are subject to internal review and assessment prior to any response or action.
Scalar Dynamic evaluates each request to determine, as applicable, its legal validity, issuing authority, jurisdictional reach, scope, proportionality, and compliance with applicable law.
Where appropriate, Scalar Dynamic may seek clarification, narrowing, modification, or additional information from the requesting party before responding.
Scalar Dynamic reserves the right to delay or decline action on any request pending completion of its legal and compliance review.
Scalar Dynamic seeks to limit compliance with legal process to the minimum scope required by applicable law.
Where a request is overly broad, disproportionate, unclear, or seeks information or action beyond what is legally required, Scalar Dynamic may object to, challenge, or seek to narrow the scope of such request in accordance with applicable law.
Scalar Dynamic may refuse to comply with requests that are unlawful, improperly issued, or that conflict with applicable data protection, privacy, or confidentiality obligations.
Nothing in this Policy obligates Scalar Dynamic to disclose information or take actions beyond those strictly required by law.
Scalar Dynamic may receive requests from law enforcement agencies, governmental authorities, regulatory bodies, or courts seeking information, data, access, or action related to the Services.
Such requests are handled in accordance with this Policy and applicable law and are subject to verification of authority, jurisdiction, and legal validity.
Scalar Dynamic shall comply only with requests issued by competent authorities acting within their lawful powers and shall not provide voluntary or informal access to Customer data or systems.
Emergency requests may be handled on an expedited basis where permitted by law, subject to subsequent verification and documentation.
Scalar Dynamic discloses Customer data only where disclosure is required by valid and legally binding legal process or applicable law, and only to the extent strictly necessary to comply with such obligations.
Disclosures are limited in scope, content, and duration to what is reasonably required, taking into account data protection, confidentiality, and proportionality principles.
Scalar Dynamic does not provide direct access to Customer systems or environments to third parties unless expressly required by law and subject to appropriate safeguards.
Where permitted by applicable law, Scalar Dynamic applies reasonable technical and organizational measures to protect Customer data during any disclosure process.
Where legally permitted, Scalar Dynamic shall use commercially reasonable efforts to notify Customer prior to disclosing Customer data or taking action in response to legal process or governmental requests.
Notification may include information regarding the nature of the request, the requesting authority, and the scope of the information sought, subject to legal and confidentiality constraints.
Customer acknowledges that Scalar Dynamic may be prohibited by law, court order, or governmental directive from providing notice, or may be required to delay notice for a specified period.
Scalar Dynamic shall not be liable for any failure or delay in providing notice where such notice is restricted or prohibited by applicable law.
In certain circumstances, Scalar Dynamic may be legally prohibited from providing notice to Customer regarding a legal process, governmental request, or disclosure of Customer data.
Such circumstances may include, without limitation, requests accompanied by non-disclosure obligations, gag orders, secrecy requirements, or other legal restrictions imposed by applicable law, court order, or governmental authority.
Where notice is prohibited or delayed, Scalar Dynamic shall comply with such restrictions and, where legally permitted, shall provide notice to Customer after the restriction has been lifted or expires.
Scalar Dynamic shall not be liable for any delay, omission, or failure to provide notice where such notice is restricted or prohibited by law.
Scalar Dynamic has no obligation to challenge, contest, appeal, or litigate any legal process, governmental request, or regulatory action on Customer’s behalf.
Any decision to object to, challenge, or seek modification of legal process is made by Scalar Dynamic in its sole discretion and solely for its own interests and compliance obligations.
Customer remains responsible for asserting its own legal rights and remedies with respect to any legal process affecting it.
Scalar Dynamic shall act in good faith when responding to legal process, governmental requests, and regulatory obligations, taking into account applicable law, customer rights, proportionality, and operational impact.
In fulfilling its legal obligations, Scalar Dynamic may take actions it reasonably determines are necessary or appropriate, including disclosure of information, restriction of access, suspension of services, preservation of data, or other compliance measures.
Where reasonably possible and not prohibited by law, Scalar Dynamic shall seek to minimize unnecessary disruption to Customer operations while complying with its legal obligations.
Actions taken by Scalar Dynamic in good faith to comply with legal process or applicable law shall not constitute a breach of any agreement and shall not give rise to liability.
Scalar Dynamic may suspend, restrict, modify, or terminate access to the Services, in whole or in part, where required or reasonably necessary to comply with applicable law, legal process, governmental request, regulatory obligation, or court order.
Such actions may be taken without prior notice where notice is prohibited by law or where immediate action is required to ensure legal compliance, prevent harm, or mitigate risk.
Scalar Dynamic shall not be liable for any loss, damage, or disruption arising from suspension or restriction of Services taken in good faith to comply with legal obligations.
Customer remains responsible for all fees and obligations accrued prior to and during any period of suspension or restriction, to the extent permitted by applicable law.
Scalar Dynamic may maintain records relating to legal process, governmental requests, disclosures, and compliance actions as required by applicable law or internal compliance requirements.
Where required by law or regulation, Scalar Dynamic may cooperate with audits, inspections, or inquiries conducted by competent authorities in connection with legal or regulatory obligations.
Any disclosure of records or information in connection with audits or inspections shall be limited to what is legally required and subject to applicable confidentiality and data protection obligations.
Scalar Dynamic shall not be obligated to provide Customer with access to internal compliance records or audit materials unless required by applicable law or expressly agreed in writing.
To the maximum extent permitted by applicable law, Scalar Dynamic shall not be liable for any damages, losses, costs, or liabilities arising out of or related to actions taken in good faith to comply with legal process, governmental requests, regulatory obligations, or applicable law.
This limitation applies without limitation to disclosures of information, suspension or restriction of Services, preservation of data, delayed notification, or any other compliance-related actions.
Nothing in this Policy shall be construed to limit liability where such limitation is prohibited by applicable law.
Scalar Dynamic may receive notices, complaints, or other communications from third parties or authorities that are issued under, or reference, laws or legal frameworks to which Scalar Dynamic is not directly subject or that are not independently binding on Scalar Dynamic.
Notwithstanding the foregoing, certain notices may constitute or provide actual knowledge, constructive notice, or legally relevant awareness of alleged unlawful activity, infringement, or other violations governed by laws that are applicable to Scalar Dynamic. In such cases, the legal effect of the notice arises not from the originating jurisdiction or legal framework cited therein, but from Scalar Dynamic’s receipt of the information and the obligations that such receipt may trigger under applicable law.
By way of example, a notice alleging copyright or intellectual property infringement may be issued pursuant to a legal regime that is not directly applicable to Scalar Dynamic; however, the factual allegations contained in such notice may nonetheless give rise to duties under applicable law once Scalar Dynamic is informed of the alleged infringement, including obligations to assess, act upon, restrict access to, or otherwise address the reported content.
Accordingly, Scalar Dynamic may review and act upon notices for the limited purpose of complying with its own legal obligations, regardless of whether the notice itself constitutes valid legal process or is enforceable in the jurisdiction from which it originates.
Nothing in this Section shall be construed as an acknowledgment that Scalar Dynamic is subject to, or bound by, the laws of the jurisdiction referenced in a notice, nor as a waiver of any rights to contest the validity, scope, or applicability of such notice or the underlying allegations.
Legal process, governmental requests, or regulatory notices originating from jurisdictions in which Scalar Dynamic does not operate or is not legally established shall not be considered valid or enforceable unless submitted in accordance with applicable international cooperation mechanisms.
Where required by applicable law, such requests must be transmitted through appropriate mutual legal assistance treaties (MLATs), letters rogatory, or other formally recognized cross-border legal processes and addressed to the competent authority in the relevant jurisdiction.
Scalar Dynamic shall not voluntarily comply with foreign legal requests that are not properly issued, recognized, or enforceable under applicable international, European Union, or Estonian law.
Nothing in this Section obligates Scalar Dynamic to accept or act upon informal, direct, or extraterritorial requests from foreign authorities outside established legal cooperation frameworks.
Where Scalar Dynamic receives legal process, governmental requests, regulatory notices, or other demands for information that purport to apply extraterritorially or originate from a jurisdiction whose laws conflict with the laws applicable to Scalar Dynamic or the relevant data, Scalar Dynamic shall not automatically comply with such requests.
In the event of an actual or potential conflict of laws, Scalar Dynamic shall conduct a documented assessment to determine whether and to what extent compliance is legally permissible. This assessment may include, without limitation: (i) whether the requesting authority has lawful jurisdiction over the relevant Scalar Dynamic entity; (ii) whether Scalar Dynamic has a valid legal obligation to comply; (iii) whether compliance would violate applicable data protection, confidentiality, secrecy, or other mandatory laws; (iv) whether the request is necessary and proportionate; and (v) whether alternative lawful mechanisms for cooperation are available.
Where compliance with a request would require disclosure of data or information in violation of applicable law, Scalar Dynamic shall decline to comply directly and shall require the request to be pursued through appropriate and formally recognized intergovernmental or judicial cooperation mechanisms, such as mutual legal assistance procedures, letters rogatory, or equivalent lawful processes.
If Scalar Dynamic maintains entities, assets, personnel, or operations in multiple jurisdictions, any request shall be addressed to the specific entity that is lawfully subject to the requesting authority and has lawful possession, custody, or control of the requested information. Scalar Dynamic shall not restructure, bypass, or otherwise re-route data or access in order to facilitate compliance where doing so would circumvent applicable legal protections.
Where permitted by law, Scalar Dynamic may seek to challenge, narrow, or defer compliance with a request, including by requesting clarification, invoking principles of comity, proportionality, or necessity, or seeking review by a competent court or authority.
Nothing in this Section shall be construed as an obligation for Scalar Dynamic to voluntarily disclose data or information, to waive applicable legal protections, or to comply with requests that are informal, non-binding, or not legally enforceable against Scalar Dynamic under applicable law.
Scalar Dynamic may update or modify this Policy from time to time to reflect changes in law, regulatory guidance, operational practices, or the Services.
Updates become effective upon publication or upon such other effective date specified by Scalar Dynamic.
Customer’s continued use of the Services after an update constitutes acceptance of the updated Policy.
If Customer does not agree to an updated Policy, Customer’s sole remedy is to discontinue use of the Services, subject to any applicable contractual obligations.
All legal process, governmental requests, regulatory notices, and other legally binding communications must be submitted to Scalar Dynamic through one of the authorized channels and must be addressed to the specific Scalar Dynamic entity that is legally established in, or otherwise lawfully subject to, the jurisdiction asserted in the request and that has lawful possession, custody, or control of the relevant customer, service, or data.
Requests addressed to an incorrect Scalar Dynamic entity, or to an entity lacking lawful jurisdictional nexus, legal authority, or control over the requested information, shall not be considered valid or enforceable and may be rejected or redirected without further action.
The appropriate Scalar Dynamic entity shall be determined based on one or more of the following factors, as applicable: (i) the location of the contracting customer (if any); (ii) the location where the relevant service is provided; (iii) the location where the data is stored or processed; and (iv) the legal establishment or operational presence of the Scalar Dynamic entity with authority over the requested information.
All Scalar Dynamic legal entities, including their respective legal establishments and jurisdictions of operation, are identified and listed in the Impressum . If the appropriate Scalar Dynamic entity or applicable jurisdiction cannot be reasonably established, any request must be addressed to Scalar Dynamic’s entity established in Tallinn, Estonia.
Requests must be submitted exclusively through the following authorized channels:
Requests submitted through any other channel, including support systems, sales contacts, or informal communications, shall not be deemed valid or received for purposes of legal compliance.
Scalar Dynamic reserves the right to require resubmission of any request that is not delivered in accordance with this Section.
Nothing in this Section shall be construed as an acknowledgment that any Scalar Dynamic entity is subject to the laws or jurisdiction of any authority solely by virtue of receiving a request or notice.
